Case Summary:

The plaintiff, Walter Ackerman, brought suit against Callaway Contracting and our client, T.J. Blume & Son, Inc., alleging that he was working on a construction site in East Boston, Massachusetts when he was struck by the bucket of a backhoe, causing him to sustain serious personal injuries. The plaintiff alleged that the negligent operation by the defendants, or either of them, was the cause of this accident. He further alleged that our client was the owner of the Bobcat tractor involved in this incident. We were able to successfully establish that the plaintiff was unable to prove that the Bobcat was owned by T.J. Blume, or that our client had any such equipment at the site at time of the incident.

Results:

Summary judgment was granted by Judge Patrick Brady on behalf of our client.
