Case Summary:
We successfully defended a commercial landlord in a slip-and-fall accident on snow and ice. The plaintiff suffered a torn rotator cuff resulting in a permanent loss of function of the left shoulder of 55% based on the A.M.A. guidelines. The plaintiff incurred approximately $15,000 in medical bills. An M.G.L. ch. 93A/176D count against the insurer was stayed at the beginning of litigation in Suffolk Superior Court. The defendant denied the presence of the unnatural condition, pleading the affirmative defense of fraud.
Results:
The jury deliberated for approximately four days before returning a Defendant’s verdict. A subsequent post-trial motion to dismiss the M.G.L. ch. 93A/176D suit was allowed by the Court.
