Case Summary:

We successfully defended this suit alleging violations of M.G.L. c. 93A and M.G.L. c. 176D against our client, Pilgrim Insurance Company. The plaintiffs alleged that our client failed to properly and reasonably investigate and settle their claims for personal injury arising out of a motor vehicle accident in which they were passengers in a vehicle struck by a vehicle being operated by Pilgrim's insured. At trial, the plaintiffs relied on testimony of an expert witness with more than thirty years of experience in the insurance industry. We defended our client based on Pilgrim's prompt and reasonable investigation of the plaintiffs' claims, including their good faith reliance on the advice of an accident reconstruction expert and defense counsel.

Results:

After plaintiffs' case, our motion for directed finding was allowed by Judge Mary Dacey-White.
