Case Summary:

This case arose out of a workplace altercation between the plaintiff and co-defendant. The plaintiff, who sustained serious injuries including nerve damage and bulging discs, received workers’ compensation benefits from his employer and filed a third-party suit against the co-defendant and our client. The plaintiff alleged that the co-defendant was an employee of our client, an affiliated company, rather than a co-worker for the same employer. The plaintiff’s wife alleged a loss of consortium.

Results:

Summary judgment was granted by Judge Peter Lauriat for the defendants.
