Case Summary:

The plaintiff, Amy Guadalupe, filed suit on behalf of her minor daughter, Tyishia, alleging that our client, Kohl's Department Stores, Inc., was negligent in allowing a dangerous and defective condition to exist at its store in Medford, Massachusetts in the form of a sock display rack. The plaintiff alleged that this allegedly defective condition of the premises was the proximate cause of her daughter's trip and fall accident and resultant right eye injury. We were able to successfully establish that the plaintiff failed to provide evidence to substantiate her claim of a defective condition and that her claim was based on nothing more than speculation and conjecture.

Results:

Summary judgment was granted by Judge Catherine White on behalf of our client.
