Case Summary:

The plaintiff, Frances DeRosa, filed suit against numerous defendants alleging that she was injured in a motor vehicle accident involving a taxicab which was insured by Pilgrim Insurance Company. Ms. DeRosa pursued this matter as a pro se plaintiff and brought claims, inter alia, for violation of M.G.L. c. 93A and M.G.L. c. 176D against our client, Pilgrim Insurance Company. We defended this case based on our position that Pilgrim did not commit any unfair or deceptive acts or practices in its handling of Ms. DeRosa’s claim pre-suit, as well as on the fact that the plaintiff failed to comply with the formal prerequisites of M.G.L. c. 93A.

Results:

Judgment was entered by Judge Carol Ball on behalf of our client, Pilgrim Insurance Company.
