Gene Bressette v. Donna Bressette
Date:
June 2002
Venue:
Hampden Superior Court
Springfield, Massachusetts
Case Summary:
We defended the insured homeowner in this case in which the plaintiff alleged that he sustained a disc herniation and cervical cord compression, as well as permanent neurological deficits, as a result of his fall down the exterior porch stairs at the insured’s property where he was an invited guest for Easter. Our client had removed the handrails on the stairs two weeks prior to the incident, and the porch light was inoperable due to a longstanding problem with leakage from the roof in violation of the State Building Code. The plaintiff was intoxicated at the time of his fall.
Results:
The jury deliberated for less than two hours before returning a verdict for the defendant.
